CAS dismisses Malaysian Wushu Appeal
October 02, 2014The Ad Hoc Division of the Court of Arbitration for Sport (CAS) present in Incheon for the Asian Games ruled today on the application filed by the Malaysian athlete Tai Cheau Xuen against the decision of the Olympic Council of Asia (OCA) to disqualify her from the 17th Asian Games and to withdraw her medal.
Tai Cheau Xuen won a gold medal in the sport of Wushu on 20 September 2014, but subsequently tested positive for the banned stimulant sibutramine (A and B samples). The athlete decided to challenge the OCA decision as she noted some departures from the International standard for testing procedure. She filed an application at the ad hoc Division of CAS on 1 October 2014. A hearing was held this morning before a CAS Panel composed of Justice Catherine Davani (Papua New Guinea), President, Prof. Dong Su Ahn (Korea) and Ms Thi My Dung Nguyen (Vietnam) in the presence of the Chef de mission of the Olympic Council of Malaysia, representing the athlete, and of the OCA representatives. The Panel rendered its decision at 3:30pm today, dismissing the application of the athlete and confirming the OCA decision to disqualify her from the Games. As a consequence, the medals in the women’s Wushu Nanquan and Nandao competition will be re-allocated by OCA.
